PowerNap for iOS
Everything the PowerNap app does with your information, what you agree to when you use it, and who is legally responsible for it.
PowerNap runs entirely on your iPhone. It has no user accounts, no servers of our own, no analytics, no advertising and no tracking of any kind. We do not receive your motion data, your nap history or any identifier from the app, because the app never sends them anywhere.

Because none of this data reaches us, there is no legal basis for processing by us to declare, no recipients, no transfers to third countries by us, and no automated decision-making or profiling.
You can withdraw either permission at any time in iOS Settings → PowerNap. Withdrawal does not affect the lawfulness of any processing that already took place on your device.
The app is distributed through the Apple App Store, and PowerNap Pro is sold by Apple as a one-time in-app purchase. Apple acts as its own controller for the data it collects when you download the app, make a purchase, or send us a crash report through Apple's own tools. That processing is governed by Apple's Privacy Policy, not by this one. If you opt in to sharing analytics with developers in iOS, Apple may make aggregated, anonymised crash and usage statistics available to us; these cannot be linked to you.
You have the right to access (Art. 15), rectification (Art. 16), erasure (Art. 17), restriction (Art. 18), data portability (Art. 20) and objection (Art. 21), as well as the right to lodge a complaint with a supervisory authority (Art. 77).
In practice: because your data never leaves your device, we hold nothing about you and cannot identify you. You can exercise erasure and portability yourself at any time — clear your history in the app, or delete the app, which removes everything it stored. If you email us, we will of course process that email in order to reply to you (Art. 6(1)(f) GDPR, our legitimate interest in answering support requests); we keep support correspondence no longer than necessary.
The supervisory authority responsible for us is the Landesbeauftragte für den Datenschutz und die Informationsfreiheit Rheinland-Pfalz, Hintere Bleiche 34, 55116 Mainz, Germany.
PowerNap is not directed at children under 13 and does not knowingly process their data. As no data is collected, there is nothing for us to delete on request.
If the app ever starts processing data differently, we will update this page and the "last updated" date above before the change ships.
These terms govern your use of the PowerNap iOS application ("the app") provided by HBJ-Solutions GbR ("we", "us"). By installing or using the app you agree to them. They apply in addition to Apple's Licensed Application End User License Agreement, which governs your licence to the app itself; where that agreement and these terms conflict on the licence, Apple's agreement prevails.
We grant you a non-exclusive, non-transferable, revocable licence to use the app on Apple-branded devices you own or control, for your own personal, non-commercial purposes. You may not reverse engineer, decompile, resell, rent or redistribute the app, except to the extent that mandatory law expressly permits it.
Right of withdrawal (consumers in the EU): purchases of digital content made through the App Store are concluded with Apple as the merchant of record, and Apple's own withdrawal and refund terms apply to them. Where a statutory 14-day right of withdrawal exists for digital content, it may lapse once the content has been made available to you with your express consent — Apple obtains that consent at the point of purchase.
PowerNap estimates when you fall asleep from movement measured by your iPhone's accelerometer. This is an estimate based on a single, indirect signal. It can miss a sleep onset entirely, and it can be triggered by something that is not sleep at all — a passing lorry, a pet on the bed, a phone knocked off a nightstand.
We are liable without limitation for damage caused intentionally or by gross negligence, for injury to life, body or health, and under the German Product Liability Act (Produkthaftungsgesetz). For slight negligence we are liable only where we breach a material contractual obligation — one whose fulfilment makes proper performance of the contract possible in the first place and on whose fulfilment you may regularly rely — and in that case only for foreseeable damage typical of this kind of contract. Any further liability is excluded. This allocation of risk reflects the fact that the app is a low-cost consumer tool with no guarantee of detection accuracy. Your statutory rights as a consumer are not affected.
We may update, change or discontinue the app or individual features. We will not remove a feature you have already paid for without good reason; if we discontinue PowerNap Pro features permanently and that is unreasonable for you, contact us.
German law applies, excluding the UN Convention on Contracts for the International Sale of Goods. If you are a consumer, this choice of law does not deprive you of the protection of mandatory provisions of the law of your country of habitual residence. The European Commission provides a platform for online dispute resolution at ec.europa.eu/consumers/odr. We are neither obliged nor willing to participate in dispute resolution proceedings before a consumer arbitration board.

Short daytime naps suit most people, but not everyone. Napping can interfere with night-time sleep, and persistent daytime sleepiness can be a symptom of a condition that deserves proper attention — including sleep apnoea, narcolepsy, depression, anaemia or a thyroid disorder.
If you regularly feel you cannot get through the day without sleeping, if you fall asleep involuntarily, or if your sleep is disturbed over a long period, please see a doctor. PowerNap cannot detect any of this and is not designed to.
Hypnic jerks — the small involuntary twitch PowerNap looks for — are a normal, harmless part of falling asleep for most people. PowerNap detecting or not detecting them tells you nothing about your health.

Da uns keine dieser Daten erreicht, gibt es auf unserer Seite keine Rechtsgrundlage anzugeben, keine Empfänger, keine Drittlandübermittlung und keine automatisierte Entscheidungsfindung oder Profilbildung.
Sie können beide Berechtigungen jederzeit in den iOS-Einstellungen unter „PowerNap" widerrufen.
Die App wird über den Apple App Store vertrieben; PowerNap Pro wird von Apple als einmaliger In-App-Kauf verkauft. Für die Daten, die Apple beim Laden der App, beim Kauf oder bei über Apple übermittelten Absturzberichten erhebt, ist Apple eigener Verantwortlicher. Es gilt insoweit die Datenschutzrichtlinie von Apple. Wenn Sie in iOS der Weitergabe von Analysedaten an Entwickler zustimmen, kann Apple uns aggregierte, anonymisierte Absturz- und Nutzungsstatistiken bereitstellen; ein Personenbezug ist daraus nicht herstellbar.
Ihnen stehen die Rechte auf Auskunft (Art. 15), Berichtigung (Art. 16), Löschung (Art. 17), Einschränkung (Art. 18), Datenübertragbarkeit (Art. 20) und Widerspruch (Art. 21) sowie das Beschwerderecht bei einer Aufsichtsbehörde (Art. 77) zu.
Praktisch bedeutet das: Da Ihre Daten Ihr Gerät nie verlassen, liegt uns nichts über Sie vor und wir können Sie nicht identifizieren. Löschung und Übertragbarkeit können Sie jederzeit selbst ausüben, indem Sie die Historie in der App löschen oder die App entfernen. Schreiben Sie uns eine E-Mail, verarbeiten wir diese selbstverständlich zur Beantwortung (Art. 6 Abs. 1 lit. f DSGVO, berechtigtes Interesse an der Bearbeitung von Supportanfragen) und bewahren sie nicht länger als erforderlich auf.

PowerNap richtet sich nicht an Kinder unter 13 Jahren und verarbeitet deren Daten nicht wissentlich. Da keine Daten erhoben werden, gibt es auf Verlangen nichts zu löschen.
Sollte die App künftig Daten anders verarbeiten, aktualisieren wir diese Seite und das oben genannte Datum, bevor die Änderung ausgeliefert wird.
Diese Bedingungen regeln die Nutzung der iOS-App PowerNap („die App") der HBJ-Solutions GbR („wir", „uns"). Mit Installation oder Nutzung der App stimmen Sie ihnen zu. Ergänzend gilt Apples Lizenzvereinbarung für Endkunden (Licensed Application EULA); bei Widersprüchen hinsichtlich der Lizenz geht die Vereinbarung von Apple vor.
Wir räumen Ihnen ein einfaches, nicht übertragbares, widerrufliches Recht ein, die App auf Geräten der Marke Apple, die Sie besitzen oder kontrollieren, für private, nicht gewerbliche Zwecke zu nutzen. Zurückentwicklung, Dekompilierung, Weiterverkauf, Vermietung und Weiterverbreitung sind untersagt, soweit nicht zwingendes Recht dies ausdrücklich erlaubt.
Widerrufsrecht für Verbraucher: Käufe digitaler Inhalte im App Store kommen mit Apple als Verkäufer zustande; es gelten insoweit die Widerrufs- und Erstattungsbedingungen von Apple. Ein gesetzliches 14-tägiges Widerrufsrecht für digitale Inhalte kann erlöschen, sobald der Inhalt mit Ihrer ausdrücklichen Zustimmung bereitgestellt wurde — diese Zustimmung holt Apple beim Kauf ein.
PowerNap schätzt anhand der Bewegungsdaten des Beschleunigungssensors, wann Sie einschlafen. Das ist eine Schätzung auf Basis eines einzigen, indirekten Signals. Sie kann ein Einschlafen vollständig übersehen und ebenso durch etwas ausgelöst werden, das gar kein Einschlafen ist — einen vorbeifahrenden Lastwagen, ein Haustier auf dem Bett, ein vom Nachttisch gestoßenes Telefon.
Wir haften unbeschränkt für Vorsatz und grobe Fahrlässigkeit, für Schäden aus der Verletzung des Lebens, des Körpers oder der Gesundheit sowie nach dem Produkthaftungsgesetz. Bei einfacher Fahrlässigkeit haften wir nur bei Verletzung einer wesentlichen Vertragspflicht — einer Pflicht, deren Erfüllung die ordnungsgemäße Durchführung des Vertrags überhaupt erst ermöglicht und auf deren Einhaltung Sie regelmäßig vertrauen dürfen — und dabei begrenzt auf den vertragstypischen, vorhersehbaren Schaden. Eine weitergehende Haftung ist ausgeschlossen. Ihre gesetzlichen Verbraucherrechte bleiben unberührt.
Wir können die App oder einzelne Funktionen aktualisieren, ändern oder einstellen. Bereits bezahlte Funktionen entfernen wir nicht ohne triftigen Grund. Sollten wir Pro-Funktionen dauerhaft einstellen und ist Ihnen das unzumutbar, wenden Sie sich bitte an uns.
Es gilt deutsches Recht unter Ausschluss des UN-Kaufrechts. Als Verbraucher verlieren Sie dadurch nicht den Schutz zwingender Vorschriften Ihres gewöhnlichen Aufenthaltsstaats. Die Europäische Kommission stellt eine Plattform zur Online-Streitbeilegung bereit: ec.europa.eu/consumers/odr. Zur Teilnahme an einem Streitbeilegungsverfahren vor einer Verbraucherschlichtungsstelle sind wir weder verpflichtet noch bereit.

Kurze Nickerchen am Tag tun den meisten Menschen gut, aber nicht allen. Sie können den Nachtschlaf stören, und anhaltende Tagesmüdigkeit kann Symptom einer behandlungsbedürftigen Erkrankung sein — etwa einer Schlafapnoe, Narkolepsie, Depression, Blutarmut oder Schilddrüsenstörung.
Wenn Sie regelmäßig das Gefühl haben, ohne Schlaf nicht durch den Tag zu kommen, unfreiwillig einschlafen oder über längere Zeit schlecht schlafen, suchen Sie bitte ärztlichen Rat. PowerNap kann derartiges nicht erkennen und ist dafür nicht gemacht.
Einschlafzuckungen — jenes kurze unwillkürliche Zucken, nach dem PowerNap sucht — sind bei den meisten Menschen ein normaler, harmloser Teil des Einschlafens. Ob PowerNap sie erkennt oder nicht, sagt nichts über Ihre Gesundheit aus.
